International Marriage Broker Regulation Act 2005
In January 2006, the United States passed a new law to regulate the matchmaking and dating industry called the International Marriage Brokers Regulation Act 2005. This new law went into effect on March 06, 2006.

A: Below is an excerpt from the IMBRA law as taken from the United States Federal Registry defining an International Marriage Broker and its exceptions:
(4) INTERNATIONAL MARRIAGE BROKER.
(A) IN GENERAL. The term "international marriage
broker" means a corporation, partnership, business, individual,
or other legal entity, whether or not organized
under any law of the United States, that charges fees
for providing dating, matrimonial, matchmaking services,
or social referrals between United States citizens or
nationals or aliens lawfully admitted to the United States
as permanent residents and foreign national clients by
providing personal contact information or otherwise facilitating
communication between individuals.
(B) EXCEPTIONS. Such term does not include:
(i) a traditional matchmaking organization of a
cultural or religious nature that operates on a nonprofit
basis and otherwise operates in compliance with the
laws of the countries in which it operates, including
the laws of the United States; or
(ii) an entity that provides dating services if its
principal business is not to provide international dating
services between United States citizens or United
States residents and foreign nationals and it charges
comparable rates and offers comparable services to
all individuals it serves regardless of the individual's
gender or country of citizenship.
Q: How is Latin Love Search exempt from being an International Marriage Broker?
A: The law states ONLY international dating services that charge its members money for dating services are considered International Marriage Brokers.

Q: How will this law effect International Marriage Brokers?
A: Matrimonial services that are defined as an International Marriage Broker will be required to obtain criminal and other background information from all U.S. citizens, nationals or legal aliens that are members of the service.
The background and personal disclosures must be translated into the native languages of all the foreign clients and made available for the non-U.S. clients to review.
The foreign client must acknowledge they have received this information and give the matrimonial service permission to allow the United States client and foreign client to contact each other.
There are very serious monetary and criminal penalties for an International Marriage Broker for failure to comply with the new regulations.
Q: What could happen if I met someone through an International Marriage Broker?
A: If the International Marriage Broker complies with the new regulations, there should not be any problems. However, if the International Marriage Broker fails to comply with the new regulations, you or your future spouse may be denied a U.S. fiance or K-1 visa.
